2. Scope and acceptance

These Terms of Service ("Terms") govern your access to and use of gottigourmetusa.com (the "Site") and any purchase of products from Gotti. By browsing the Site, creating an account, or placing an order you accept these Terms in the version published at that time. If you do not agree, please do not use the Site.

3. Products and food disclaimer

We sell premium extra virgin olive oil and related gourmet food products. Descriptions, images and specifications are provided as accurately as possible; images are indicative and packaging or labeling may vary slightly.

Our products are foods. Please review the product information for ingredients and allergens before consuming. Statements on the Site have not been evaluated by the U.S. Food and Drug Administration (FDA) and are not intended to diagnose, treat, cure or prevent any disease, nor do they constitute medical or nutritional advice.

4. Prices and taxes

All prices are shown in U.S. dollars (USD). Applicable sales/use tax and shipping are not included in the product price and are calculated and displayed at checkout before payment, based on your destination and order.

We may change prices at any time without notice; changes do not affect orders already confirmed and paid.

5. Order process

The purchase is completed in the following steps:

1. Add the desired products to your cart.
2. Review your cart and quantities.
3. Enter or confirm your shipping and billing details.
4. Select a shipping method and review the cost.
5. Choose a payment method and complete the transaction.
6. You will receive a confirmation email summarizing your order and, once shipped, tracking information.

Your order constitutes an offer to buy. A binding contract is formed when we confirm shipment of your order.

6. Order acceptance and cancellation

We may refuse, limit or cancel any order or quantity (per person, household or order), and may correct pricing or descriptive errors and cancel affected orders even after submission. If we cancel a paid order, we will refund the amount charged.

7. Payment

Payment is processed by our third-party payment providers. You represent that you are authorized to use the payment method provided and that the information you supply is accurate.

8. Shipping, returns and refunds

Shipping is governed by our Shipping Policy and returns/refunds by our Refund & Return Policy, which form part of these Terms.

9. Subscriptions — Gotti Club

If you enroll in a recurring plan (the "Gotti Club"), you authorize us to charge your payment method on the frequency you selected until you cancel. Plans renew automatically at the then-current price. You may pause or cancel at any time from your account or by contacting us; cancellation is effective for the next billing cycle and does not affect shipments already processed.

10. Customer accounts

You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

11. Promotions, loyalty and referrals

Discount codes, the loyalty/points program and referral rewards are subject to their specific conditions, may not be combined unless stated, and may be modified or discontinued at any time. They have no cash value.

12. Acceptable use

You agree not to misuse the Site, interfere with its operation, attempt unauthorized access, or use it for any unlawful purpose.

13. Intellectual property

All content on the Site (texts, images, logos, trademarks and design) is owned by or licensed to Gotti and is protected by law. It may not be reproduced or used without our prior written permission.

14. Disclaimers and warranties

The Site and products are provided "as is" and "as available" to the maximum extent permitted by law. We do not warrant that the Site will be uninterrupted or error-free, or that the products will meet your expectations. On-screen colors may vary by device.

15. Limitation of liability

To the maximum extent permitted by law, Gotti shall not be liable for any indirect, incidental, special, punitive or consequential damages, or for loss of profits or data. Nothing in these Terms limits liability that cannot be limited under applicable law.

16. Indemnification

You agree to indemnify and hold harmless Gotti from claims arising out of your breach of these Terms or your misuse of the Site.

17. Force majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including carrier disruptions, severe weather, or supply shortages.

18. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules.

19. Dispute resolution

We encourage you to contact us first so we can resolve any issue informally. Any dispute not resolved this way shall be submitted to the state or federal courts located in Florida, unless applicable consumer law provides otherwise.

20. Changes to these Terms

We may update these Terms from time to time. The "last updated" date reflects the current version; continued use of the Site after changes constitutes acceptance.

22. Sales tax

Orders shipped to Florida are subject to Florida sales tax. We collect the 6% Florida state sales tax plus the applicable county discretionary sales surtax based on the delivery address. The discretionary sales surtax applies only to the first ,000 of the sales amount of a single item of tangible personal property; the state tax has no such limit. The surtax rate is set by the county to which your order is delivered and may change each year. Orders delivered outside Florida are not charged Florida sales tax; you may be responsible for reporting and paying any applicable use tax in your own state. The exact tax is shown at checkout before you confirm your order.
